Application for 2021 compensation
On 13 May 2022 AS Eesti Post applied for compensation for year 2021 unreasonably burdensome costs of the universal postal service (UPS), the Competition Authority did not take into account costs in the amount of 0.5 million euros which AS Eesti Post disputed in court after Competition Authority rejected the appeal in full on 02 January 2024. On 12 August 2024, the court of first instance made a decision in favor of AS Eesti Post and obliged the Competition Authority to decide again on the satisfaction of the request of AS Eesti Post dated 13 May 2022. Competition Authority filed an appeal on 11 September 2024. Proceeding is ongoing and the outcome of the case is unpredictable. No date for the next hearing is set, and it is unlikely it will happen before the end of the year.
Application for 2022 compensation
In course of supervisory procedure conducted by the Competition Authority regarding the compensation for the unreasonably burdensome costs of the 2022 universal postal service, AS Eesti Post requested compensation in total amount 2.2 million euros. However, the Competition Authority’s decision approved only compensation in the amount of 0.3 million euros, received in February 2025. AS Eesti Post has initiated a dispute of this decision in court on 14 March 2025, with a hearing held on 20 June 2025. By its judgment of 03.10.2025, the Tallinn Administrative Court fully satisfied the appeal of Eesti Post and annulled the decision of the Competition Authority in the contested part. The court ordered the Competition Authority to re-examine Eesti Post’s application in the part that had previously been rejected. The Competition Authority have appealed this decision, and EP will provide its response in December 2025.
